Terms and Conditions

1. Definitions

• Service: The Host A Tourney platform, including all functionalities for creating, managing, and presenting tournaments.
• User: Any natural person or legal entity who creates an account or uses the Service.
• Account: Het persoonlijke gebruikersaccount waarmee toegang wordt verkregen tot de Dienst.
• Content: All data entered by the User, including tournament names, team names, scores, and images.
• AI-Generated Schedules: Tournament draws and match schedules that are automatically generated by artificial intelligence.

2. Applicability

These General Terms and Conditions apply to any use of the Service and to all agreements between Host A Tourney and the User. By creating an account or using the Service, you agree to these terms.

3. Account Registration and Security

To use the Service, you must create an account. You are responsible for:

• Providing correct and current information upon registration
• Keeping your password and login details confidential
• All activities that occur under your account
• Immediately reporting any unauthorized use of your account

You may not share your account with third parties or transfer it without our permission.

4. Services and Subscriptions

4.1 Free Plan

The free plan offers limited access to the Service, including the creation of one tournament.

4.2 Demo Plan

Temporary extended access can be obtained via demo codes. Demo codes are personal and non-transferable.

4.3 Premium Subscription

The Premium subscription offers unlimited access to all features for an annual fee. Payments are processed via Stripe.

5. Payments and Refunds

• All prices are inclusive of VAT, unless stated otherwise.
• Payments are processed securely via Stripe. We do not store any credit card details.
• Subscriptions are automatically renewed unless cancelled in time.
• You can cancel your subscription at any time. Access will remain active until the end of the paid period.
• Refunds are assessed on a case-by-case basis and may be granted within 14 days of purchase if the Service has not been used significantly.

6. AI-Generated Content

Our Service uses artificial intelligence (AI) to generate tournament draws and match schedules. While we strive for optimal results:

• AI-generated schedules may contain errors or inaccuracies
• We do not guarantee that generated schedules are completely correct or optimal
• You, as the User, are responsible for checking and, if necessary, adjusting generated schedules
• We accept no liability for any consequences resulting from the use of AI-generated schedules

7. User Content

You retain all rights to the Content you upload or enter. By posting Content, you grant us a limited license to use it for the purpose of providing the Service.

You guarantee that your Content:

• Does not infringe on the intellectual property rights of third parties
• Does not violate any laws or public order
• Does not contain any misleading, offensive, or discriminatory content
• Does not contain any viruses or malicious code

8. Prohibited Use

You are not permitted to:

• Use the Service for illegal purposes
• Circumvent or disrupt the security of the Service
• Interfere with other users or access their accounts
• Use automated systems to overload the Service
• Reverse-engineer or copy the Service
• Use the Service for commercial resale without permission

9. Intellectual Property

All rights to the Service, including but not limited to the software, designs, logos, and trademarks, remain the property of Host A Tourney or its licensors.

Nothing in these terms grants you any rights to our intellectual property, except for the limited right to use the Service in accordance with these terms.

10. Privacy

Your privacy is important to us. We process your personal data in accordance with the General Data Protection Regulation (GDPR). The data we collect includes:

• Account data: username, email address, password (encrypted)
• Tournament data: tournament names, team names, scores, settings
• Payment data: transaction information (credit card details are processed by Stripe)
• Usage data: session information for the functioning of the Service

We do not share your data with third parties, except where necessary to provide the Service (e.g., Stripe for payments) or where legally required.

11. Availability and Maintenance

We strive for high availability of the Service, but cannot guarantee that the Service will be available uninterrupted at all times. We reserve the right to:

• Temporarily interrupt the Service for maintenance or updates
• Modify or remove functionalities
• Terminate the Service entirely with reasonable notice

12. Limitation of Liability

To the extent permitted by law:

• The Service is provided "as is" without any warranty
• We are not liable for indirect or consequential damages, lost profits, or loss of data
• Our total liability is limited to the amount you have paid to us in the past 12 months

These limitations do not apply to damages caused by intent or gross negligence on our part.

13. Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination:

• You will lose access to your account and all Content
• No amounts already paid will be refunded, unless the termination is attributable to us
• You may request an export of your data within 30 days of termination

14. Changes

We may change these terms from time to time. Material changes will be announced via email at least 30 days in advance. Continued use of the Service after a change constitutes acceptance of the new terms.

15. Applicable Law and Disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
